VILLA KESTEL - Rental Conditions 2006

 


1. General

These booking conditions have been formulated as a result of our responsibilities under law.  They do not affect your statutory rights. All bookings are made and accepted subject to the terms set out in these conditions and the information detailed on our website: www.alanyavilla.com  

The person in whose name the booking is made acts on behalf of all other persons named, must be over 18 years of age and becomes responsible to us for all payments in respect of the booking. We require the names of all individual guests who will be staying at the villa. We will send you a booking form and a flight information form.

We do not allow anyone to visit the villa that is not on your guest list. This is very important as uninvited guests who are found at the villa will be charged for as if they had stayed for the full length of the letting, and maybe asked to leave as well. What we do not want either is for our guests to bring back "friends" who they meet on holiday or friends who they arrange to meet on holiday. We also do not allow one guest to replace another guest who is already staying at the Villa.

It is a condition of booking that you have adequate insurance on your holiday.

We accept responsibility for the acts and/or omissions of our employees, agents, and suppliers while acting within the scope of, or in the course of their employment with us.  We also accept responsibility for any deficiencies in the services we are contractually obliged to provide, or the failure of such services to reach a reasonable standard.

We are unable to accept responsibility for any aspect of your holiday affected by matters over which we have no control.  These include war or threat of war, riots and civil strife, terrorist activity, natural or nuclear disaster, weather conditions, fire, flood, drought, industrial disputes, government action, airport regulations and closures or technical transportation problems which may affect the scheduling of aircraft or other transport or other circumstances amounting to Force Majeure.  We do not accept responsibility in respect of death, bodily injury or illness of any person taking one of our holidays, except when caused by the negligent acts and/or omissions of our employees, agents, suppliers or sub-contractors while acting within the scope of, or in the course of their employment, agency, contract of supply or sub-contractor. We have done our best to ensure that our brochure / web site is accurate at the time of going to press.  On occasions, especially during low season, certain facilities or amenities such as water sports, swimming pools, restaurants etc. may not be open or available as advertised due to maintenance, weather conditions, and lack of demand or for other reasons outside our control.

Any special requests must be advised to us at the time of booking and clearly noted on the booking form.  Whilst we will endeavour wherever possible, to meet or pass onto suppliers any reasonable special requests we cannot guarantee that they will be fulfilled.  Any failure to meet special requests will not be a breach of contract on our part.  If you or any member of your party has any medical condition or disability which may affect your holiday, it is vital that you tell us before you confirm your booking so that we can advise as to the suitability of the chosen accommodation.

The requirements and standards of the country you are visiting apply to services provided there and these may be lower than those of the UK. Suppliers providing the services which make up your holiday do so in accordance with their own terms and conditions.  Some of these terms and conditions may limit or exclude the supply of liability to you, usually in accordance with International Conventions.

We plan your holidays well in advance. And though it is unlikely that we will have to make any changes to confirmed bookings, it can happen.  Changes are usually of a minor nature, and we will advise at the earliest possible date, if there is time, before your departure. All flight details should be confirmed by you when completing and signing the “Flight Information Form”. This is particularly important as we are arranging transfers.

2. Payments

When you make the booking a contract is made, and we will confirm your booking as soon as we receive a completed and signed booking form.  

When booking your holiday form you must pay the deposit, which is normally 35%. If the booking is within 12 weeks of departure then full payment is due. An invoice will be sent to for the balance of monies owing.  

Your reservation will be confirmed upon payment of a deposit.  We usually allow 3 working days for your booking form and monies to reach us.  The balance of your holiday cost must be received by us at least 12 weeks before departure date.

Please note that you will  receive a reminder that final payment is due.  Please also ensure you send payment in sufficient time for us to pay-in and clear your payment through your bank (usually 7 days is enough for this), otherwise your booking will be cancelled, and you will be liable to pay cancellation charges as shown below.

THE PRICE OF STAYING IN OUR VILLA IS GUARANTEED.

Exceptions to the above

Breakages or Damage to the villa or contents (see section 6 – Security Deposit & Refunds)

The price shown on your confirmation/invoice is fully guaranteed provided conditions of payment are adhered to.

3. Cancellations and Refunds

The deposit that you paid to secure your booking  is  non-refundable ( This is usually 35% of the whole amount). Customers would not receive any refund of any paid balance unless cancellation is made 12 weeks prior to departure. Any such paid balance will be refunded in the proportions below and any such cancellation might incur some additional administration and cancellation charges.

       Cancellations must be made by registered post and signed by the Customer.

       Cancellation made within the

       14th  week prior to departure will receive   40% of the balance as refund

       16th  week prior to departure will receive   50% of the balance as refund

       18th  week prior to departure will receive   60% of the balance as refund

       22nd week prior to departure will receive   80% of the balance as refund

       24th  week prior to departure will receive   90% of the balance as refund

       26th  week prior to departure will receive 100% of the balance as refund

If you wish to change your holiday in any way, and we accept the change, the following charges will apply.  Timescales refer to the date of receipt of your instructions in writing. If you wish to cancel your holiday, the person in whose name the holiday is ( The Party Leader) , must inform us in writing and this should be sent to us by Recorded Delivery.  In the event of cancellation or part cancellation, the following charges become payable:

We reserve the right, in EXCEPTIONAL circumstance, to cancel your holiday. If due to events beyond our control, we are no longer able to provide the rental period originally booked, we will return your money in full. This will exclude the cost travelling to the resort (i.e. airfares, transfers, taxis etc.)

We reserve the right, in EXCEPTIONAL circumstances, to ask guests to leave the Villa. This would only be done in the event of behaviour or actions which were completely unacceptable for example illegal use of drugs, wilful damage, and violent, unruly or dangerous behaviour. In the event we would not be prepared to refund any money for any part of the booking.

We are unable to accept any liability for any delay to your flight, whether the delay or cancellation is caused by adverse weather conditions, the action of air traffic controllers, the action of airport authorities or governments, the rescheduling of times by the airline, mechanical breakdown, strike or industrial action or otherwise.  In such circumstances you may be able to make a claim under your insurance policy problems to transport, closure or disruption of airspace or airports or seaports, cancellation of scheduled airline or sea services, or other events outside our control.

4.  Electric / Air Conditioning.

On arrival and again on departure from the accommodation a meter reading will be taken by our agents. You will be informed of this reading and charged accordingly at the current local unit rate.

Excessive use of the A/C i.e. leaving it running all day in bedrooms or running the A/C with windows / doors left open etc will have a significant effect on the electric consumption and charges.

With reasonable and sensible use £30.00 - £40.00 per week should be adequate to cover your  A/C / electricity usage.

NB:  All electric charges are to be made to Alanya Property Management Company before your departure

 It is in your interest to ensure the A/C units are switched off when not required.

5. Complaints procedure

If a problem arises during your holiday, it is important that you advise Alanya Property Management  at the earliest opportunity, and they will endeavour to put things right. The complaint must be followed up upon your return to the UK, by writing, within 28 days of your return. It is unlikely that you will have a complaint that cannot be settled amicably.  

6. Security Deposit / Refunds

You are responsible for any breakages or damages caused by you or any member of your party during your stay in our accommodation. A security deposit cheque of £200.00  per booking made payable to – J. P French is required with your final balance 12 weeks prior to your departure. The security deposit covers the following:-

 Any damage to the property or contents being reported by the Alanya Property Management Company

Subject to no damage being reported  - your security / breakages deposit will be refunded in full to you  two weeks after your return.  

7. Transfers

All transfer charges to and from Antalya Airport are excluded from the rental rates.  Airport transfers are paid locally to the Alanya Property Management team prior to departure.

These Booking Conditions are valid until 31st December 2006.
