1. Holiday Tenancy The agreement is made on the basis that The Beach House is to be occupied by the Tenant for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9 and the Tenant acknowledges that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends. 2. Reservation We shall hold your provisional reservation for 7 days. If we have not received your signed booking confirmation with the deposit within 7 days, we regret that the reservation will be cancelled. 3. Deposit A deposit of 50% of the full tariff must accompany the booking. The person signing the booking, who must be over 21 years of age, must have the authority and responsibility to accept all the conditions on behalf of all other party members. Cheques should be made payable to P. Lowther. Deposits are non-returnable unless we are unable to accept the booking and as specified below. The balance of the tariff must be paid at least six weeks before the start date, together with a refundable damage bond (cheque) for £100 which will be held against damage, loss, excessive consumption of services and excessive final cleaning. If your holiday begins less than six weeks from the time of booking, the full tariff and damage bond are payable on booking. Failure to comply may result in the cancellation of the holiday and forfeiture of the deposit and payment of the full cancellation charges. 4. Cancellation Cancellation will result in the loss of the deposit, and unless the accommodation can be re-let, liability for the total cost. Cancellations must be received in writing. Holiday insurance is very strongly recommended – you can find details of suitable cancellation and holiday insurance and compare prices and cover at http://www.datafinanceuk.com/travel.asp In the event of cancellation an administration fee of £20.00 will be charged. 5. Guests The number of guests permitted to stay at The Beach House shall not exceed six people. Groups of single sex parties will not be accepted. Behaviour of guests and visitors should not be excessive or rowdy, especially at night. Offensive or illegal behaviour will not be tolerated. 6. Reasonable Access Reasonable access to the property by the owners and/or our authorised representatives must be allowed at all times. 7. Damages and Breakages Guests will keep the holiday accommodation and all furniture, fixtures, fittings and effects in or on the cottage in the same state of repair as at the commencement of the holiday, and shall leave the cottage in the same state of cleanliness and general order in which it was found. Guests must report and pay to the owners the cost of any damage or breakages made during their holiday occupancy. 9. Breaking the Terms and Conditions Failure to comply with any of the booking conditions, may result in the party (ies) being asked to leave immediately, if in the owner’s sole discretion they feel the conditions have been infringed. No refunds will be given in these circumstances. 10. Complaints In the event of there being cause for complaint concerning the property, the matter should be taken up with the owners at once. It is important that this is done whilst you are still at the property so that an on the spot investigation can be made if necessary by our local representatives and remedial action taken if required. In no circumstances will compensation be made for complaints raised after the tenancy has ended when the Tenant has denied the owners or their authorised representative the opportunity of investigating the complaint and endeavouring to put matters right during the tenancy. 11. Liability Personal belongings are the responsibility of each member of the party. The owners accept no liability whatsoever for any accident, loss or damage to your property, unless such loss etc is demonstrably due to their negligence. The owners cannot be held responsible for the failure of public services, (e.g. water, gas, electricity etc) or any disturbance which is beyond their control. In all cases, their liability to you for the cost of all claims arising out of your holiday with them is limited to the cost of the booking. 12. Safety of Children The site sits upon a cliff above the harbour which means children must be supervised at all times. 13. Cars Cars are parked at owners risk. 14. Arrival and Departure Times The Beach House bookings run from Saturday to Saturday (unless agreed by prior arrangement). Tenancies commence at 3pm on the day of arrival and terminate at 10am on the day of departure. 15. Smoking & Pets The Beach House operates a strict no smoking, no pets policy.
